Please read these Terms of Service ("Terms") carefully before using the Rad Onc Oral Board Sim application ("the App"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Eligibility

You must meet the following requirements to use the App:

• Be at least 18 years of age
• Be a healthcare professional, medical student, or resident
• Provide accurate registration information
• Maintain the security of your account

3. Educational Purpose Only

The App DOES NOT:

• Provide medical advice, diagnosis, or treatment recommendations
• Replace clinical judgment or professional medical training
• Substitute for actual patient care experience
• Guarantee passing of any certification examination

All clinical scenarios are AI-generated for educational simulation and should not be applied to actual patient care without appropriate clinical oversight.

4. User Accounts

Account Creation

• You must verify your email address to access certain features
• You are responsible for maintaining the confidentiality of your account
• You must notify us immediately of any unauthorized access
• One account per person; account sharing is prohibited

5. Credits and Subscriptions

Free Credits

New verified users receive 3 free case credits upon email verification. These credits are non-transferable and expire if the account is deleted.

Purchased Credits

• Credits are consumed when generating AI cases
• Credits are non-refundable once used
• Unused credits do not expire
• Credits are tied to your account and non-transferable

Subscriptions

• Subscriptions provide unlimited case generation
• Automatically renew unless canceled 24 hours before renewal
• Can be canceled anytime through your Apple ID settings
• Refunds handled per Apple's standard refund policy

6. AI-Generated Content

The App uses artificial intelligence (OpenAI) to generate clinical scenarios and provide feedback.

Important Disclaimers:

• AI-generated content may contain errors or inaccuracies
• Clinical scenarios are fictional and for educational purposes only
• AI feedback should not replace instructor or mentor guidance
• Always verify information against authoritative clinical sources
• Do not enter real patient information or protected health information (PHI) into the App

7. Intellectual Property

All content, features, and functionality of the App are owned by Navid Fallahi and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute App content
• Reverse engineer or decompile the App
• Use the App for commercial purposes without permission
• Share your account credentials with others

8. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or servers
• Create multiple accounts to abuse free credits
• Use automated systems to access the App
• Interfere with the proper functioning of the App

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any reason we deem necessary to protect the App and its users.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not guarantee:

• Accuracy, completeness, or timeliness of content
• Uninterrupted or error-free operation
• Success in board examinations
• Fitness for any particular purpose

You agree to indemnify and hold harmless Navid Fallahi and the App from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data collection and usage practices.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the App after changes constitutes acceptance of the modified Terms.

15. Apple Licensed Application End User License Agreement

This App is licensed, not sold, to you. Your use of the App is also subject to the terms and conditions of Apple's Licensed Application End User License Agreement ("Apple EULA"), which is incorporated herein by reference.

In the event of a conflict between these Terms and the Apple EULA, these Terms shall take precedence to the extent permitted by applicable law.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Virginia.

17. Dispute Resolution

Before initiating any legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at navfallahi@gmail.com. We will attempt to resolve the dispute within 30 days.

If the dispute cannot be resolved informally:

• Any dispute shall be resolved through binding arbitration administered under the rules of the American Arbitration Association
• Arbitration shall take place in the Commonwealth of Virginia
• The arbitrator's decision shall be final and binding
• You waive any right to participate in a class action lawsuit or class-wide arbitration against the App or its developer
